Deferred prosecution agreements (DPAs) are legal means, alternative to trial, for the resolution of criminal business cases. Although DPAs are increasingly used in the US and are spreading to other jurisdictions, the ethics of DPAs has hardly been subjected to critical scrutiny. We use a multidisciplinary approach straddling the line between philosophy and law to examine the ethics of DPAs used to resolve cases of multinational enterprises’ (MNEs) foreign corruption. Deontologically, we argue that the normativity of DPAs raises critical concerns (...) related to the notion of justice as punishment, with serious cases of international corruption resolved with minimal retribution for offending MNEs. Taking a utilitarian ethical perspective, we also evaluate the effect of DPAs on MNEs’ tendency to self-regulate or re-offend. Our conclusion, supported by critical analysis of the juridical literature and case evidence on MNEs’ recidivism, is that DPAs do not foster ethical behavior. (shrink)

The subject of bullying has received widespread academic attention, going back to pioneering studies in the 1970s. However, work in this area has tended to take a gender-neutral/male perspective that does not distinguish between male and female bullying. While retaining a dialogue with generalist literature on the subject, this article seeks to highlight the theoretical and political-social relevance of gender-specific and intersectional approaches when exploring the question of bullying between adolescent girls. Based on the study _Il bullismo femminile a scuola. (...) Un’indagine intersezionale mixed-method_ (Female bullying at school, an intersectional, mixed-method study) – conducted in medium-sized and large cities in northern, central and southern Italy – it proposes a theoretical-analytical framework in which to consider the phenomenon of female bullying in Italian schools. Por que a teoria política normativa voltada para questões de justiça social e política deveria se ocupar de princípios no âmbito daquilo que John Rawls denominou “teoria ideal”, em contraste com a “teoria não ideal” da justiça? Será que necessitamos desenvolver e refinar uma teoria ideal da justiça para determinar o que a justiça requer nas condições não ideais com as quais no defrontamos? Será que a “teoria ideal” da justiça é capaz de orientar a ação – decisões políticas e (...) escolhas institucionais – em condições não ideais? Se a resposta para essas duas perguntas for “não”, então deveríamos acima de tudo nos empenhar em desenvolver uma teoria não ideal da justiça. Nas versões mais fortes dessa objeção, como a de Amartya Sen em The Ideia of Justice, podemos dispensar inteiramente a teoria ideal da justiça. Contra essa linha de objeção, que também é sustentada, de formas distintas, por autores como Onora O’Neill, Colin Farrelly e Charles Mills, este artigo desenvolve uma argumentação em duas etapas. Em primeiro lugar, sustenta-se que há razões para valorizar a teorização ideal que são independentes da relação que possa ter com a teoria não ideal. Em uma segunda etapa, sustenta-se que a teoria ideal da justiça, embora deixe enorme quantidade de trabalho (empírico e normativo) a ser feito, é imprescindível para determinar o que a justiça requer de nós aqui e agora. This article aims to analyze the philosophical and religious message of Julian’s Hymn to King Helios. The emperor, using Iamblichean structures, shows how the First Cause, the Neoplatonic One, can interact with the layers or gradation below it, including the physical world ; his starting point is an original ‘pluralizing’ interpretation of the Sun analogy contained in Resp. VI 509b.However, Julian’s hymn has a political meaning, too ; it can be considered as a sort of manifesto of Julian’s imperial ideology. (...) The parallel between the emperor and the sun – already present in the ancient rhetorical tradition – is reworked by the Apostate and is part of a complex metaphysical‑cosmological system, grounded on the principles of similarity and middleness. These concepts were subject to controversy between nicene and heterodox christians in the IV century. It is possible that these controversies were largely known by Julian and that he has consciously recalled them in his panegyric to Helios intellective, mediator and saviour. (shrink)

This article aims to show that Julian the Emperor had some knowledge of Middle Platonic doctrines. More specifically, the discussion focuses on the case of Plutarch of Chaeronea.We can find interesting parallels between the works of this philosopher and the Orations of Julian, especially concerning the allegorical exegesis of myths, the crucial metaphysical role played by Apollo-Helios and the doctrine of the soul. It is worth considering the possibility that Plutarch's works partially inspired Julian's concept of Hellenism.

Summary What is the “fantasmatic deixis”? It is a very creative and productive cognitive–linguistic operation that allows a “transfer” to other real or fantastic times, places, and “worlds”. The underlying psychological question concerns the possibility of moving and being moved with respect to something or someone who is absent (Bühler, 1965). This “fiction game” is made possible by deictic indicators (Tenchini, 2008), terms that allow motion in time and space, always considering the here–now–I system of subjective orientation. When we refer (...) to something that can be gathered by hearing or by sight, by terms such as here, there, I, and you, the receiver can easily use natural, prelinguistic aids (e.g., gestures, voice quality, facial expressions, and body orientation) to understand what the issuer intends to communicate to him (demonstratio ad oculos). But what happens when we move from the study of “immediate” behavior to that of “mediate” behavior, i.e., the field of memories (retrospection) or the constructive fantasy (prospecting)? The fantasmatic deixis implies enfranchisement from the physical position of the body and requires the assumption of the listener’s current tactile body image. Thus, the receiver assumes an inner attitude to correctly interpret the indications given by the speaker, seeing and hearing through the “inner” or “mental” eye and ear (Raynaud, 2006). In this way, the listener can bring something absent in his/her here, now, and I or feel moved to the point where the speaker leads him/her. My paper will focus on the features and types of fantasmatic deixis, providing some examples and showing how this operation involves language, motion, and cognitive processes. (shrink)

In the rhetorical tradition of Late Antiquity, Socrates’ legend has a good fortune in the works of different rhetoricians and philosophers. In the following pages I am going to deal with some examples of this phaenomenon, through the works of Themistius and Julian the emperor : two intellectuals of the IV century who are, under many aspects, the exact opposites.They both try to ‘actualize’ Socrates’ figure, highlighting different aspects of the Athenian philosopher, on the grounds of their personal purposes of (...) self-advertisement. So Themistius, a skilled politician working as princeps’ advisor, sees in Socrates a symbol of the ‘politikos philosophos’, who speaks plainly in public with people of all ranks, in a simple and direct way ; for Julian, emperor and philosopher of the new Hellenism, Socrates, instead, is mainly the saviour of the souls, addressing all men towards the true knowledge of themselves and the true faith in pagan gods. These portraits are complementary and both attest the ability of Late Antique intellectuals in their imitatio/aemulatio of figures and myths of Classical Antiquity. (shrink)

This article regards a particular way through which adults take children into consideration and listen their voices. Reflections have sprung from a research context, focused on existential questions that children pose during their preschool years in early education settings. The research explored the meanings of these questions for children and adults involved in their education. The questions of meaning emerged by children’s discourses are considered through the representations of childhood that subtend parents and teachers’ educational practices. The article discusses one (...) of these representations, that of philosopher child, with regard on his various internal perspectives. Lipman, Kyle, Martens and Matthews are some of the authors taken into consideration in order to examine briefly some traditional approaches of doing philosophy with children and to understand the practices that teachers operate everyday in early childhood education and care services. Although classical evolutionary theory, i.e., population genetics and the Modern Synthesis, was already implicitly ‘gene-centred’, the organism was, in practice, still generally regarded as the individual unit of which a population is composed. The gene-centred approach to evolution only reached a logical conclusion with the advent of the gene-selectionist or gene’s eye view in the 1960s and 1970s. Whereas classical evolutionary theory can only work with (genotypically represented) fitness differences between individual organisms, gene-selectionism is capable of working with fitness differences (...) among genes within the same organism and genome. Here, we explore the explanatory potential of ‘intra-organismic’ and ‘intra-genomic’ gene-selectionism, i.e., of a behavioural-ecological ‘gene’s eye view’ on genetic, genomic and organismal evolution. First, we give a general outline of the framework and how it complements the—to some extent—still ‘organism-centred’ approach of classical evolutionary theory. Secondly, we give a more in-depth assessment of its explanatory potential for biological evolution, i.e., for Darwin’s ‘common descent with modification’ or, more specifically, for ‘historical continuity or homology with modular evolutionary change’ as it has been studied by evolutionary developmental biology (evo-devo) during the last few decades. In contrast with classical evolutionary theory, evo-devo focuses on ‘within-organism’ developmental processes. Given the capacity of gene-selectionism to adopt an intra-organismal gene’s eye view, we outline the relevance of the latter model for evo-devo. Overall, we aim for the conceptual integration between the gene’s eye view on the one hand, and more organism-centred evolutionary models (both classical evolutionary theory and evo-devo) on the other. RESUMO Este artigo apresenta e discute acontecimentos que emergiram no decorrer de uma pesquisa-intervenção com jovens, visando problematizar as contribuições para a formação ética, estética e política tanto dos pesquisadores como dos participantes. Oficinas estéticas mediadas por linguagens artístico-visuais consistiram no modus operandi da pesquisa-intervenção, sendo os acontecimentos relativos à oficina de graffiti o foco das análises aqui apresentadas. Participaram dessa oficina entre 20 a 25 jovens matriculados em uma escola pública municipal de Florianópolis/SC, com idades entre 13 e 16 (...) anos. As atividades foram coordenadas por bolsistas de IC e extensão, graduandos de psicologia, e um bolsista AT, grafiteiro. Os registros das atividades foram feitos via filmagens, fotografia e registros em diário de campo. As análises foram realizadas a partir de uma perspectiva dialógica, com foco na responsividade que conota as ações e pauta a condição alteritária da existência.ABSTRACT This paper presents and discusses events that emerged in the course of research involving an intervention conducted with youngsters. The objective was to discuss contributions to ethical, aesthetic and political formation of both the researchers and participants. Aesthetic workshops mediated by artistic-visual languages consisted of the modus operandi of the intervention research, and the events related to a graffiti workshop were the focus of this analysis. From 20 to 25 youngsters, aged between 13 to 16 years old and enrolled in a city public school in Florianópolis, SC, Brazil participated. The activities were coordinated by undergraduate research assistants, senior psychology students, and one graffiti artist who received a Technical Support scholarship. The activities were filmed, photographed and recorded in a field diary. The analyses were conducted from a dialogic perspective focusing on responsiveness that connotes the actions and grounds the otherness nature of existence. (shrink)

AbstractWhile the literature on oncofertility decision-making was central to the bioethics debate on social egg freezing when the practice emerged in the late 2000s, there has been little discussion juxtaposing the two forms of egg freezing since. This article offers a new perspective on this debate by comparing empirical qualitative data of two previously conducted studies on medical and social egg freezing. We re-analysed the interview data of the two studies and did a thematic analysis combined with interdisciplinary collaborative auditing (...) for empirical ethics projects. Despite their different contexts, major similarities in women’s decision-making and reasoning were found. We developed two main common themes. Firstly, women felt a clear need to plan for future options. Secondly, they manipulated decision-times by postponing definitive decisions and making micro-decisions. The comparison highlights that the passage of time and the preservation of future choice seems to permeate all aspects of the patient experiences in both studies. As a result of considering real-world lived experiences, we suggest that there are many overlaps in women’s reasoning about egg freezing regardless of why they are making a decision to freeze. These overlaps are morally relevant and thus need to be further integrated into the existing arguments that have been canvassed in the flourishing egg freezing and fertility preservation debates across the field, and in policy and practice globally. One of the most profound and influential studies of this pivotal event, it remains a relevant and stimulating discussion of the problem of preserving individual and political freedom in the modern world. Alan Kahan's translation provides a faithful, readable rendering of Tocqueville's last masterpiece, and includes notes and variants which reveal Tocqueville's sources and include excerpts from his drafts (...) and revisions. The nineteenth-century French writer examines the development of democratic government in the United States and the state of political and social life.

First the ‘Weismann barrier’ and later on Francis Crick’s ‘central dogma’ of molecular biology nourished the gene-centric paradigm of life, i.e., the conception of the gene/genome as a ‘central source’ from which hereditary specificity unidirectionally flows or radiates into cellular biochemistry and development. Today, due to advances in molecular genetics and epigenetics, such as the discovery of complex post-genomic and epigenetic processes in which genes are causally integrated, many theorists argue that a gene-centric conception of the organism has become problematic. (...) Here, we first explore the causal implications of the following two central dogma-related issues: (1) widespread reverse transcription—arguing for an extension from ‘DNA-genome’ to RNA-encompassing ‘NA-genome’ and, thus, from traditional DNA-centrism to a broader ‘NA-centrism’; and (2) the absence of a mechanism of reverse translation—arguing for the ‘structural primacy’ of NA-sequence over protein in cellular biochemistry. Secondly, we explore whether this latter conclusion can be extended to a ‘functional primacy’ of NA-sequence over protein in cellular biochemistry, which would imply a limited kind of ‘gene/NA-centrism’ confined to the subcellular level of NA/protein-based biochemistry. Finally, we explore the conditions—and their (non)fulfilment—for a more generalised form of gene-centrism extendable to higher levels of biological organisation. We conclude that the higher we go in the biological hierarchy, the more dubious gene-centric claims become. (shrink)

Are White, All the Blacks Are Men, But Some of Us Are Brave: Black Women's Studies, I imagined a wealth of examples of the world and the work made possible by these two groundbreaking anthologies. I wondered what their editors and contributors were writing now. I wondered about the work of their students and people like me: those of us who understand everything we write as indebted to the path-making, silence-clearing, generative, and bodacious work of the participants in the miracles that are This Bridge Called My Back and But Some of Us Are Brave.But today as I reread the contributions that actually emerged from this process, I realize that my dream was too small. I imagined writing that would provide evidence of the ongoing impact made by these two anthologies. Instead, the creative writing in this special issue offers something more crucial and beautiful than I had imagined. These works are not mere evidence of a transformed world; these works are continuing to transform the world in urgent and visionary ways. As repeated again and again by participants in the 2022 celebration for the fortieth anniversary celebration of This Bridge Called My Back, the work that inspired these anthologies is not over. The writings featured in this issue not only show [End Page 198] how this work continues, but they feed, nurture, and provoke us as we honor our responsibility to transform this world.For example, when Akasha Gloria Hull, coeditor of But Some of Us Are Brave, shares her daily early morning meditative writing in "Writing and Rebirth: A Set of Journal Poems," we remember not only her fundamental work excavating the daily lives of Black women writers from the nineteenth century—most notably in Give Us Each Day, her edited book based on the diaries of poet Alice Dunbar Nelson—but also our own imperative. Hull's reflections on health challenges, interpersonal conflict, resurrection, collaboration, and writing itself remind us that our feminist praxis is impactful because of its dailyness. Those of us who wake up tomorrow will need to ask the same critical questions the editors of But Some of Us Are Brave asked of the fields of Black studies and women's studies. We will find surprises and repetitions in the days we meet, and then we will have to do it again.When we read two new prose poems by Cheryl Clarke, an original contributor to This Bridge Called My Back, we have an opportunity to time travel. In "Living as a Lesbian in the Archive of Style," we venture into a critical engagement with the term "hardcore lesbian," displacing the desires of the person who needs to classify others using that term with those of someone who has been hailed by it. Clarke's poem is a reminder that as we work in literary traditions and fields of study made possible by the revolutionary identity politics of an earlier era, we are still responsible for centering the experiences of those most impacted by our fluent and fluid naming practices. In "History," Clarke offers us a timely Black lesbian feminist lens on many iterations of responding to police violence, centering the perspective of a lesbian, her lover, and her lover's husband.The poem "On Being an hbcu Graduate, Teacher, Professor-Scholar at Stillman College, Tuscaloosa, AL, in May 2015" by doris diosa davenport—an original contributor to But Some of Us Are Brave—highlights the intimacy, hilarity, and poignancy of the daily work of intergenerational critical and creative praxis. In particular, she considers the context of institutions and regions that are sometimes excluded from the imaginary of how and where feminist work happens. davenport transmits the lessons and energy gained through her practice of thinking and gathering otherwise... In a 2007 paper, we argued that speakers with Autism Spectrum Disorders exhibit pragmatic abilities which are surprising given the usual understanding of communication in that group. That is, it is commonly reported that people diagnosed with an ASD have trouble with metaphor, irony, conversational implicature and other non-literal language. This is not a matter of trouble with knowledge and application of rules of grammar. The difficulties lie, rather, in successful communicative interaction. Though we did find pragmatic errors within literal (...) talk, the transcribed conversations we studied showed many, many successes. A second paper reinforced our finding of a general level of success. It considered differences within the class of pragmatically-inflected yet literal speech acts. The present paper carries our project forward. It overcomes some of the methodological limitations of the second paper, by increasing sample size, and looking at frequency of use rather than just seeming errors. It also includes a control sample. The emerging results are two-fold. On the one hand, there was a slight, statistically significant difference in frequency of use between our participants and the controls in four sub-categories: indexicals, possessives, polysemy and degree on a scale. In all four, the participants diagnosed with ASDs had fewer occurrences overall, relative to controls. On the other hand, there was no significant difference in error rates between ASDs and controls — not in any of the eight categories of pragmatic determinants of literal content that we coded for. The upshot is that, though there were less-preferred forms for participants with ASDs, they do very well indeed with pragmatic determinants of literal content. (shrink)

Philosophy in the City (or PinC, as it came to be known) is an outreach programme led by student volunteers from the University of Sheffield's Department of Philosophy. It aims to bring philosophy out of the university and into the wider urban community, stimulating young and older minds through events and activities organised with local partners, including schools, charities, and a homeless shelter. Since its inception in 2006, the project has seen hundreds of student volunteers from the university engage in (...) philosophical conversations with thousands of local residents from a wide variety of backgrounds. Sixteen years on, what can we learn from the achievements and shortfalls of this initiative? The present paper is not a systematic review of the project’s history, but a retrospective dialogue between the two authors who both participated in its foundation and its early development: Alexis Artaud de la Ferrière was the project’s first President and Joshua Forstenzer its third. In the course of this dialogue, they revisit the initial motivations and ambitions undergirding the project, discuss the obstacles faced throughout their respective tenures of leadership, and analyse the evolving mission of the project against the backdrop of historic changes in English higher education which occurred during this period. This book provides the first complete, literal English translation of Alexis de Tocqueville’s and Gustave de Beaumont’s first edition of On the Penitentiary System in the United States and Its Application to France. The work contains a critical comparison of two competing American penitentiary disciplines known as the Auburn and Philadelphia systems, an evaluation of whether American penitentiaries can successfully work in France, a detailed description of Houses of Refuge as the first juvenile detention centers, and an argument against (...) penal colonization. The work provides valuable insights into understanding Tocqueville as a statesman, as well as a comparative look at civic engagement in early American and French penal reform movements. The Translator’s Introduction provides historical context for understanding Tocqueville’s work in French penal reform and the major themes of the report. The book thus fills a void in Tocquevillian studies and extrapolates the roots of American and French criminal justice systems in the nineteenth century. (shrink)

Welch :263–279, 2017) has recently proposed two possible explanations for why the field of evolutionary biology is plagued by a steady stream of claims that it needs urgent reform. It is either seriously deficient and incapable of incorporating ideas that are new, relevant and plausible or it is not seriously deficient at all but is prone to attracting discontent and to the championing of ideas that are not very relevant, plausible and/or not really new. He argues for the second explanation. (...) This paper presents a twofold critique of his analysis: firstly, the main calls for reform do not concern the field of evolutionary biology in general but rather, or more specifically, the modern evolutionary synthesis. Secondly, and most importantly, these calls are not only inspired by the factors, enumerated by Welch, but are also, and even primarily, motivated by four problematic characteristics of the modern synthesis. This point is illustrated through a short analysis of the latest reform challenge to the modern synthesis, the so-called extended evolutionary synthesis. We conclude with the suggestion that the modern synthesis should be amended, rather than replaced. (shrink)

In der Unmittelbarkeit und Eindringlich keit der Beobachtung, in der Kraft und Schärfe der Analyse und was die grundsätzliche Bedeutung des Aspektes anbetrifft, unter dem sie die Er eignisse ihrer Zeit begriffen, konnte wohl einer dem anderen die Waage halten. Ja, in einer Hinsicht mindestens mochte Tocqueville sogar Marx übertreffen: in dem aufrichtigen Bemühen um vollständige Vorurteils losigkeit und in dem ernsten Bewußtsein der Verantwortung als Mitleben der seiner Zeit. Beide, Marx wie Tocqueville, konstatieren übereinstimmend - wenn auch aus sehr verschiedener Perspektive - zwei entscheidende Merkmale ihrer Zeit: einmal die Tendenz zu einer vollständigen Aufhebung aller gesell schaftlichen Unterscheidung, den Zug zu einer fortschreitenden Gleichheit der Vielen. Und ferner: den zwangsläufigen Charakter dieser Entwick lung, die ihre Antriebe aus der gesamten Vergangenheit und Geistesart des Abendlandes erhält. (shrink)

Le voyage en boulet occupe une place importante dans _Durée et Simultanéité_. Les arguments avancés par Bergson – pour conclure à tort à la réciprocité des expériences des jumeaux – ne sont pas sans rappeler ceux de Herbert Dingle dans sa controverse avec McCrea. Les versions épurées du pseudo-paradoxe des jumeaux, avec accélération et sans différence d’âge et celles sans accélération et avec différence d’âge, montrent qu’il n’y a pas de sens à vouloir localiser en un point précis d’une ligne (...) d’univers – en l’occurrence au point de rebroussement – la discordance des âges. Si l’ouvrage de Bergson souffre indéniablement de maladresses et de contre-sens, parfois partagés par les physiciens de son époque, il n’en demeure pas moins notable que les tentatives contemporaines de construction d’une théorie quantique de la gravité sont traversées par d’inédits questionnements sur la nature du temps et résonnent tout particulièrement avec certaines intuitions bergsoniennes.
